What you're describing is the sunk cost fallacy, and I do not think works as an argument, because by continuing to use anthropic's products you are potentially extending their lifespan/digging them out of the debt hole they currently exist in. Allowing them to tread water further only further increases the length of time that they can cut up rare books like this.
At absolute minimum you should not fuck with any projects created by or even partially funded by anthropic or openai, considering this.
I personally do not think copyright law is some sacred thing that is the exact same as moral good, and think that the actions of companies in the name of 'upholding trademark' are extremely vile, but I do not think you can really get out of 'you know for a fact that These Specific AI Companies are cutting up books and destroying them, and continuing to use the product only enables them to continue doing that'.
The ideal would be to enforce regulations regarding data centers as a whole, no matter what the usecase, to be extremely clear (as much as I love video games, the water usage on triple a games starts getting weird and scary to think about if you dig even a little bit...).
That fact does not erase that ai companies are doing harm right now. I think a lot of arguments in this topic go 'well what if everyone was different and this wasn't doing all of that'. Well, then it would all be different. Arguing based on the most upstanding version of a thing does not erase the current state of a thing, which is bad, and we have to discuss how to handle it as it currently exists.
The messed up thing is that text generation per use is actually more water and energy-intensive than image generation, so text generation is actually /more/ fucked up and unethical than the 'generate hot elf woman NOWWW' prompt stuff.
